When the right of withdrawal does not apply

EU Directive 2011/83/EU lists several categories of goods and services that are excluded from the 14-day right of withdrawal. The sections below cover the cases that may apply to this store—remove the ones that do not apply to the items you sell.

Digital content downloaded with your express consent

When you purchase digital content (downloadable files, streamed videos, online courses with immediate access, software licenses, etc.) and expressly request its immediate delivery, acknowledging that you thereby forfeit your right of withdrawal, the 14-day withdrawal period no longer applies — Art. 16(m) of Directive 2011/83/EU. Your express consent is obtained at checkout.

Services that began during the withdrawal period at your request

If you ask us to begin providing a service before the 14-day withdrawal period has expired, you may still withdraw, but you owe us a pro-rated amount for the work already performed — Art. 14(4)(a) of Directive 2011/83/EU. Your express request is recorded at checkout.

Custom-made, perishable, hygienically sealed, or sealed media items

Items made to your specifications or clearly personalized, goods likely to deteriorate or expire rapidly (perishables), items sealed for hygiene or health protection that have been unsealed after delivery, and sealed audio, video, or software recordings that have been unsealed after delivery are excluded from the right of withdrawal — Art. 16(a), (c), (d), (e), (i) of Directive 2011/83/EU.

Outdated lodging, rentals, catering, or recreational services

Services tied to a specific date or period of performance—accommodation other than for residential purposes (hotels, vacation rentals), vehicle rentals, the transport of goods, catering, and leisure services such as event tickets—are excluded from the right of withdrawal—Art. 16(l) of Directive 2011/83/EU.
